Byrd Berates Coal Industry for ‘Fear Mongering’ |

In a recent Opinion Piece, “Coal Must Embrace the Future,” Sen. Robert C. Byrd, D-W.Va., berated the coal industry in a statement for fear mongering, grandstanding and outrage as a strategy. Coal has a future, but changes are inevitable in the industry and the market, Byrd explained. “Most members of Congress, like most Americans, oppose the practice, and we may not yet fully understand the effects of mountaintop removal mining on the health of our citizens,” Byrd said. “West Virginians may demonstrate anger toward the Environmental Protection Agency (EPA) over mountaintop removal mining, but we risk the very probable consequence of shouting ourselves out of any productive dialogue with the EPA and our adversaries in the Congress.

National Coal Corp., a small Central and Southern Appalachian coal producer, was notified by the Nasdaq Stock Market on January 5, 2010, it was not in compliance with Nasdaq Marketplace Rule 5450(a)(1) because shares of its common stock closed at a per share bid price of less than $1 for 30 consecutive business days. The company has 180 calendar days (or until July 6, 2010) to regain compliance. The company said it would seek to regain compliance within this 180-day cure period. To regain compliance with the minimum bid price rule, the closing bid price of National Coal’s common stock must close at $1 per share or more for a minimum of 10 consecutive business days.

EPA Makes Announcement on Two Proposed Mountaintop Mines |

The U.S. Environmental Protection Agency (EPA) announced what it called “a path forward” on permits for two mountaintop coal mining operations in West Virginia during early January. The agency informed the U.S. Army Corps of Engineers that it supports issuing a Clean Water Act (CWA) permit for the Hobet 45 mine in Lincoln County, operated by Hobet Mining. The agency said it made this decision after extensive discussions between the EPA and the company resulted in additional significant protections against environmental impacts.

CONSOL Energy has received notice that Judge Robert C. Chambers, of the U.S. District Court for the Southern District of West Virginia, Huntington Division, has ruled that CONSOL’s Fola Operations near Bickmore, W.Va., can continue to operate past the judge’s previously imposed deadline of January 23, 2010.

Luminant Completes Construction on Oak Grove Unit 1 |

The first of two 800-megawatt units at Luminant’s new Oak Grove power plant in Robertson County, Texas, is now online, having recently achieved substantial completion. “Achieving this critical step signals the end of construction and the beginning of Luminant’s operation of another significant source of baseload generation for Texas,” said Mike Williams, chief fossil officer. “Our operations team is fully engaged in the day-to-day management of the unit, which will generate needed electricity to help meet our state’s growing power demands.”
